Abstract:
In recent years, legislation passed by the Texas Legislature has had a major impact on both large and emerging Texas technology companies in the nanotechnology field. The most prominent legislation passed during the last Texas legislative session was the Texas Emerging Technology Fund. Many new Texas laws, however, impact the formation and operation of emerging tech companies and the ability of such companies to obtain financing, recruit employees, and license intellectual property rights in inventions made at Texas-supported universities.
The presentation will focus on relevant legislation either pending and/or expected to be filed in the Texas Legislature during the present 2007 legislative session and the prospects that such legislation will pass. In addition, the presentation will provide a summary and discuss the relevance of those bills affecting nanotechnology and emerging technology companies that are most likely to pass.
Bio:
Janis Carter brings twenty years of Texas legislative and government relations experience to the Austin, Texas office of Winstead Consulting Group LLC. Prior to joining Winstead in 2002, Ms. Carter was a legislative and government affairs specialist at McGinnis, Lochridge & Kilgore, L.L.P. for four years working with the firm‚s clients on matters before state agencies and the Texas Legislature.
Ms. Carter‚s extensive experience and background working across party lines provides clients with strategic legislative and government affairs counsel in a number of areas. During the 78th and 79th Legislative Sessions, she represented clients on issues including, but not limited to, taxation, appropriations, higher education funding, finance, workers' compensation, insurance and alternative energy.
Jerry Keys is a shareholder in the Austin office of Winstead PC. He has more than thirty years of legal experience representing technology and other intellectual property-based enterprises ranging from Fortune 500 companies, multinationals and universities to startups in domestic and international matters. His legal practice focuses on intellectual property, and technology business law. Jerry is particularly experienced in providing strategic Board-level legal counseling to startups and emerging high technology companies, both in private practice and as Senior Vice President and General Counsel of a venture capital-funded Internet/information technology company. He also represents both universities and private companies in connection with university and governmental lab intellectual property and technology transfer/commercialization matters. Jerry is widely recognized for his understanding of the interplay of technology and intellectual property with business and government and for his ability to assist clients in cost effectively commercializing and monetizing their intellectual property assets.
Jerry is registered to practice before the U.S. Patent and Trademark Office. He also is a former President of the Austin Intellectual Property Law Association and a former adjunct assistant professor at The University of Texas at Austin. He has been selected by his peers to be included in the 2007 edition of The Best Lawyers in America in the specialties of Information Technology Law and Intellectual Property Law.
Jerry is also very active in regional economic development. In 2003, he received the Austin Business Journal's Rising Star Award for the Service Provider Category for his work on promoting regional economic cooperation in the Greater Austin San Antonio Corridor. He is currently Co-Chairman of the Greater Austin-San Antonio Corridor Council, a regional economic development organization.
Jerry is a frequent speaker and author on both legal issues in his areas of practice and on promoting economic development through the commercialization of University- and government-generated intellectual property. His publications include "Accelerating Technology Commercialization and Business Formation in the Greater Austin-San Antonio Corridor."
Mr. Keys received his J.D. with honors in 1975 after earning a B.S. degree in Electrical Engineering, with honors, in 1970, both from The University of Texas at Austin.
